Dear Cape Haze Neighbor,
We hope this email finds you and your family well.
As a new season begins for Cape Haze, we would like to remind all Cape Haze property owners that our community is subject to deed restrictions. These restrictions were approved by our community many years ago and apply to all properties in Cape Haze, regardless of your Cape Haze Property Owners Association (CHPOA) membership status. While CHPOA oversees the enforcement of the restrictions, all property owners have a responsibility to be compliant. We would ask everyone to review the deed restrictions and then review your properties to ensure that they are in compliance. The Board would also encourage property owners to review their property for hazards that could lead to injuries, such as broken fences and seawalls, downed trees, placement of industrial equipment and storage containers, etc. These nuisances are the responsibility of the property owners and represent possible liabilities, especially to those owners that allow or encourage others to use their property. Please let us know if you have any questions.
If a deed restriction violation is found on your property, a member from the Board will speak with you personally and give you a card indicating the nature of the violation. In the past, our experience is that most residents appreciate the neighborly reminder and address the violation quickly. Thank you! However, if the violation is not addressed, the matter will be escalated until it is resolved. Unfortunately, escalation creates stress and expense for homeowners. If the violation is temporary and exceptional, please let the Board know as quickly as possible. We appreciate your understanding and cooperation.
