Notice of Deed Restriction Reinstatement

Effective April 1, 2023

Dear Cape Haze Neighbor,

We hope that you and your family are doing well.  It is hard to believe that it has been five months since Hurricane Ian devastated our neighborhood.  On many levels, there has been tremendous progress with cleanup throughout Cape Haze and the surrounding areas.  While many of the scars from Ian will be with us for a long time, we are thankful that life is back to a stable place.  

Immediately after the storm, the CHPOA Executive Committee made the decision to suspend all deed restrictions for six months.  This was done to allow all residents the time and flexibility to clean up their properties, as well as to give county, state, and federal resources the ability to easily access our community.  Over the past month, Florida State, Charlotte County, and FEMA have ceased emergency collections. 

This letter serves as notice that the deed restriction suspension for Cape Haze will be ending on April 1, 2023.  Reinstatement of all restrictions will begin on that date.

Why do we have deed restrictions?

When Cape Haze was first developed many years ago, the developers opted to make our community deed restricted to uphold a standard that accomplished the CHPOA mission:

The mission of CHPOA is to do, that within our power, those things that will maintain or
improve the quality of life and the property values in Cape Haze

How does Cape Haze work towards compliance with deed restrictions?

              When each property owner ensures that their property is compliant to the deed restrictions, Cape Haze will remain a unique and desirable place to live.  CHPOA does have a committee that periodically reviews all properties for compliance to the deed restrictions.  If a violation is determined, there is a process in place to remedy the situation as quickly and neighborly as possible.
